Domestic workers can now change jobs without the employer’s consent

Riyadh: In the Kingdom of Saudi Arabia, domestic workers can now transfer their services to a new employer without the consent of their current employer, the Saudi Press Agency (SPA) reported.

Under the updated rules, domestic workers can transfer their services to a new employer without the consent of their current employer in the following circumstances:

  • There is evidence that there has been a delay in the payment of the domestic worker’s salary for three consecutive or interrupted months without any real reason being attributed to the domestic worker
  • Non-reception of the domestic worker within 15 days from the date of arrival in the Kingdom of the port of arrival or refuges
  • If the employer does not issue a residence permit (Iqama) to the domestic worker or does not renew it even after 30 days from the expiry date
  • The employer assigns the services of a domestic worker to others
  • Evidence that the domestic worker has been assigned to hazardous work that threatens their health or safety
  • It has been proven that the employer or a family member abused the domestic worker
  • There is a complaint by the domestic worker against the employer and the employer extends the process of investigating the complaint
  • Employer submits bogus report on domestic worker’s escape
  • Failure of the employer or his representative to attend national labor dispute settlement commissions for two sessions
  • Employer’s absence due to travel, imprisonment or any other reason resulting in inability to pay domestic worker’s wages
  • Evidence that a domestic worker’s services have been transferred to another employer without their knowledge or consent
  • Termination of the employment contract by the employer during the trial period

This decision is part of the constant efforts of the Ministry of Human Resources and Social Development to evolve its decisions and legislation in order to make the Saudi labor market in its various sectors attractive and aligned with the best world markets.
